Terms of Service

You may not use FlagScanner, its scanner feeds, alerts, incident information, maps, archives, or other services to facilitate, further, plan, commit, or evade detection for criminal activity. Scanner Log USA LLC dba FlagScanner may suspend or terminate accounts used in connection with unlawful activity and may cooperate with lawful requests from law enforcement as required or permitted by law. Scanner Log USA LLC dba FlagScanner may cooperate with law enforcement agencies in accordance with applicable law, including responding to valid legal requests for information. Scanner Log USA LLC dba Flagscanner maintains this service to engage and interact with the community, providing relevant and timely community news, information, events, distribution of crime prevention and public safety tips, traffic information, investigative requests for information, urgent notification of critical incidents which may affect residents, for people having an interest in the Flagstaff region emergency services. Any violation of these Terms of Service will result in immediate removal of your account from our site. If your account is terminated due to a violation, a refund will NOT be given. We reserve the right to update these Terms of Service at any time. Continued use of the service constitutes agreement to the new and existing terms.

Our service should never be used to report a crime or suspicious activity.  To report a crime or suspicious activity, please call 9-1-1 for emergencies or (928) 774-1414 for non-emergencies. 

Flagscanner does not have traditional business hours.  Our staff and volunteers work on an as-available basis which provides coverage through most office hours and late evenings.

SUBSCRIPTION AND COMMUNICATION

By creating an account or becoming a subscriber, you agree that Scanner Log USA LLC dba FlagScanner may send you service-related communications reasonably necessary to administer your account, membership, security, billing, and the services you request.

Marketing or promotional email and SMS communications, where offered, will be subject to any additional consent and opt-out requirements required by applicable law. Consent to receive marketing communications is not a condition of purchasing a FlagScanner membership unless expressly permitted by law.

CANCELLATION POLICY

You may cancel a recurring FlagScanner membership through the account-management options provided on the FlagScanner website or through another account-management method made available for the platform through which the membership was purchased.

Cancellation prevents the membership from renewing for another billing period. Unless otherwise stated or required by law, eligible subscriber access will continue through the end of the current paid membership period.

Canceling a membership does not delete your FlagScanner account. Account deletion is a separate action described under the Account Deletion section of these Terms.

CONTENT GUIDELINES

Flagscanner reserves the right to remove any comments that include, but are not limited to containing:

1. Profane, obscene, or sexually explicit content and/or language;
2. Content that promotes, fosters, or perpetuates discrimination based on race, creed, color, age, religion, gender, or national origin;
3. Defamatory or information asserted as fact for which the poster does not have a reasonable basis to believe is accurate;
4. Threats to any person or organization;
5. Comments in support of, or opposition to, any political candidate or ballot measures
6. Solicitation of outside commerce, including but not limited to advertising of any business or product for sale or other personal uses;
7. Conduct in violation of any federal, state, or local law;
8. Encouragement of illegal activity or violence;
9. Suggestions that a person(s) self-inflict personal injury or death or receive the same by others;
10. Information that may tend to compromise the safety or security of the public or public systems;
11. Content that violates a local ownership interest, such as a copyright, of any party;
12. Harassment or content that constitutes and/or facilitates stalking;
13. Content that violates the right to privacy;
14. Repetitive content;
15. Comments that may reasonably interfere with, inhibit, or compromise law enforcement investigations, police tactics, police responses to incidents and/or the safety of police staff and officers, firefighters, or medical personnel;
16. Posts or comments that contain any external links; and
17. Personally identifiable information of another person such as an address, dates of birth, personal phone numbers or personal email addresses, other information protected by law or medical information.

A comment posted by a member of the public on Flagscanner website or social media sites is the opinion of the commentator or poster only, and publication of a comment, or no response to a negative comment, does not imply endorsement of, or agreement by Scanner Log USA LLC dba Flagscanner, nor do such comments necessarily reflect the opinions or policies of Scanner Log USA LLC dba Flagscanner.

DISCLAIMERS

Flagscanner receives information through the use of digital and analog scanners. Although every effort will be made to provide accuracy, totality, appropriateness, and validity of the information contained on our site, Scanner Log USA LLC dba Flagscanner is not liable for any errors, omissions, or delays in the presented information or any losses, injuries, or damages arising out of the information posted. At times, stories may be copied over from press releases sent by agencies under the fair use doctrine of the US Copyright Laws, as they are used for news reporting.

CLAIMS

All claims must be filed within one year. You must bring any claim against Scanner Log USA LLC dba Flagscanner within one year of the date you could first bring the claim. If you fail to file your claim against Scanner Log USA LLC dba Flagscanner within one year, the claim is permanently barred. Any legal actions taken against Scanner Log USA LLC dba Flagscanner will result in the plaintiff bearing all legal fees. This agreement shall be governed by the laws of the state of Arizona.

LIMITATION OF LIABILITY

You can recover from Scanner Log USA LLC dba Flagscanner and its affiliates, resellers, distributors, and vendors only direct damages up to an amount equal to the amount you pay for your subscription for one month. You cannot recover any other damages, including consequential, lost profits, special, indirect, incidental, or punitive damages. The limitations and exclusions apply to anything related to all claims against Scanner Log USA LLC dba Flagscanner, including but not limited to claims related to this agreement, Scanner Log USA LLC dba Flagscanner. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or failure of its essential purpose or if Scanner Log USA LLC dba Flagscanner knew or should have known about the possibility of the damages. This provision applies to all claims that arise under, in connection with, or relate to this agreement or your subscription; that arose under, in connection with, or relate to any previous agreement or subscription or that otherwise arose before these terms went into effect, or that may arise in connection with or after or otherwise relating to the termination of this agreement or your subscription.

WAIVER OF CLASS ACTIONS

You and Scanner Log USA LLC dba Flagscanner agree that each party may bring disputes against the other party only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, including, without limitation, a federal or state class action lawsuit. However, nothing in this limits your right or Scanner Log USA LLC dba Flagscanner’s right to bring a lawsuit against each other as an individual plaintiff. This provision applies to all claims that arise under, in connection with, or relate to this agreement or your subscription; that arose under, in connection with, or relate to any previous agreement or subscription or that otherwise arose before these terms went into effect, or that may arise in connection with or after or otherwise relating to the termination of this agreement or your subscription.

INTELLECTUAL PROPERTY

You agree to not copy text or screenshots from our site to be shared publicly via social media or other.

ACCOUNT DELETION

You may request permanent deletion of your FlagScanner account and associated personal data through the account-management options provided in the FlagScanner mobile application or through the account-deletion page available on the FlagScanner website.

Account deletion is separate from membership cancellation. Canceling a paid membership does not automatically delete your FlagScanner account, and deleting your account may not automatically cancel an active recurring subscription administered by a third-party payment provider or application store. Where applicable, you should cancel any active subscription before requesting account deletion.

When an account-deletion request is completed, Scanner Log USA LLC dba FlagScanner will delete the user’s account and personal data associated with that account, except for information we are required or permitted to retain for legitimate purposes such as legal compliance, accounting and tax obligations, fraud prevention, security, dispute resolution, chargeback management, or enforcement of our agreements.

If certain information must be retained after account deletion, it will be retained only for the applicable legitimate purpose and for no longer than reasonably necessary or legally required.

Account deletion is permanent. Once completed, the account and deleted data may not be recoverable.

DATA RETENTION

Scanner Log USA LLC dba FlagScanner retains personal information only for as long as reasonably necessary to provide the Services, maintain account and membership records, comply with legal and accounting obligations, prevent fraud and abuse, resolve disputes and chargebacks, maintain security, and enforce our agreements.

Retention periods may vary depending on the type of information and the purpose for which it is maintained.

When you request deletion of your account, personal information associated with the account will be deleted except where retention of specific information is reasonably necessary or legally required for purposes including legal compliance, tax and accounting requirements, fraud prevention, security, dispute resolution, chargeback management, or enforcement of our agreements.

Information retained for these purposes will not be retained longer than reasonably necessary for the applicable purpose or legal requirement.

PRIVACY NOTICE

Scanner Log USA LLC dba FlagScanner collects and processes limited personal information when necessary to provide and secure our website, mobile applications, memberships, accounts, communications, and related services.

Depending on how you use FlagScanner, information we may process includes your name, email address, account information, membership status, authentication and session information, payment-related membership status provided by our payment or membership systems, IP address, device and technical information, pages or features accessed, communications you send to us, and other information you voluntarily provide.

Passwords entered when signing into the FlagScanner mobile application are transmitted securely for authentication and are not intentionally retained by the mobile application after authentication.

Authentication credentials or session tokens may be securely stored on a user’s device when necessary to maintain a signed-in session. These credentials are used to authenticate the user’s account and provide authorized access to FlagScanner services.

COMMENTS SENT BY EMAIL

You may choose to provide us with personal information, as in an e-mail message containing your comments or questions. We use this information to improve our service to you or to respond to your request. There are times when your message is forwarded, as e-mail, to other Scanner Log USA LLC dba Flagscanner employees/volunteers who may be better able to help you. Except for authorized law enforcement investigations or public record disclosure laws, we do not share your e-mail with any other outside individuals or organizations. However, since police, fire, EMS, sheriff, and DPS are public institutions, it should be assumed that your email to us may at some point become part of the public record.

MOBILE APPLICATIONS

FlagScanner services may be accessed through the FlagScanner website and official FlagScanner mobile applications distributed through third-party application stores, including the Apple App Store and Google Play.

These Terms apply to your use of both the FlagScanner website and official FlagScanner mobile applications.

Your FlagScanner account may be used across supported FlagScanner platforms. Certain features, including subscriber-only incident content, live scanner audio, scanner archives, arrest logs, and other member features, may require an eligible active membership.

Your use of a FlagScanner mobile application may also be subject to applicable terms and policies of the platform through which the application is distributed, including Apple or Google. Where applicable, those platform requirements apply in addition to these Terms.

PAID MEMBERSHIPS, BILLING AND AUTOMATIC RENEWAL

Certain FlagScanner content and features require a paid membership. The applicable price, billing interval, and material membership terms will be disclosed before purchase.

Unless otherwise expressly stated at the time of purchase, recurring FlagScanner memberships automatically renew at the applicable recurring rate and billing interval until canceled.

You authorize the applicable payment provider to charge the payment method associated with your membership for each recurring billing period until the membership is canceled.

You may cancel a recurring membership using the account-management method applicable to the service through which the membership was purchased. Cancellation prevents future renewal. Unless otherwise stated or required by law, cancellation does not provide a prorated refund for an unused portion of a current paid membership period, and eligible membership access may continue until the end of that paid period.

If FlagScanner offers memberships for purchase through Apple, Google, or another third-party platform, billing, renewal, cancellation, and refund procedures for those purchases may additionally be governed by that platform’s applicable terms and policies.

Refunds: Except where required by applicable law or the policies of the payment platform through which a membership was purchased, payments already processed are non-refundable. Canceling a membership prevents future renewal but does not entitle the subscriber to a full or partial refund for the current billing period.
