Scanner Log USA LLC, doing business as FlagScanner (“FlagScanner,” “we,” “us,” or “our”), respects the privacy of users of FlagScanner.com and our official FlagScanner mobile applications.

This Privacy Policy explains how we collect, use, process, store, protect, disclose, and delete information when you use our website, mobile applications, memberships, accounts, live scanner services, archives, maps, incident information, alerts, and other FlagScanner services (collectively, the “Services”).

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. INFORMATION WE COLLECT

The information we collect depends on how you interact with FlagScanner and which Services you use.

Information You Provide to Us

When you create or use a FlagScanner account, purchase or maintain a membership, contact us, or otherwise interact with our Services, we may receive information including:

  • Your name;
  • Email address;
  • Username or account identifier;
  • Account and membership information;
  • Communications you send to FlagScanner;
  • Information you voluntarily provide when requesting customer support, submitting information, or communicating with us; and
  • Other information you voluntarily provide through our Services.

Account and Membership Information

If you have a FlagScanner account or paid membership, we may process information necessary to administer that account or membership, including:

  • Account identity;
  • Membership level;
  • Membership status;
  • Membership start, renewal, cancellation, or expiration information;
  • Payment-related membership status;
  • Account authorization and entitlement information; and
  • Records necessary to administer or support your membership.

FlagScanner uses this information to determine whether an account is authorized to access subscriber-only content and features.

Authentication Information

When you sign into the FlagScanner mobile application, your username or email address and password are transmitted securely to our systems for authentication.

The FlagScanner mobile application does not intentionally retain your password after authentication.

Authentication credentials or session tokens may be securely stored on your device when necessary to maintain your signed-in session. These credentials are used to authenticate your account and provide authorized access to FlagScanner Services.

Session credentials may be refreshed, rotated, expired, or revoked for account and security purposes.

Payment Information

Payments for FlagScanner memberships may be processed by third-party payment providers.

FlagScanner does not intentionally store complete payment-card numbers or card security codes within the FlagScanner mobile application.

We may receive and maintain information associated with a payment or membership transaction, such as payment status, membership status, transaction records, billing period, renewal information, or identifiers necessary to administer memberships, provide customer support, prevent fraud, resolve disputes or chargebacks, and maintain legally required business and accounting records.

If FlagScanner offers memberships through Apple, Google, or another third-party platform in the future, those transactions may also be subject to the privacy practices and policies of the applicable platform.

2. INFORMATION COLLECTED AUTOMATICALLY

When you use FlagScanner, our servers and service providers may automatically receive limited technical information necessary to operate, secure, maintain, and troubleshoot the Services.

This may include:

  • Internet Protocol (IP) address;
  • Date and time of requests;
  • Browser type;
  • Device or operating-system information;
  • Requested pages, resources, or application features;
  • Server and application request information;
  • Error or diagnostic information;
  • Authentication and security events; and
  • Other technical information necessary for security, reliability, and operation of the Services.

We may use this information to operate FlagScanner, prevent abuse, investigate technical problems, maintain security, diagnose failures, and understand the performance of our Services.

3. MOBILE APPLICATION DATA

Our official FlagScanner mobile applications communicate with FlagScanner servers to provide application functionality.

Depending on the features you use, the mobile application may transmit or receive information necessary to:

  • Authenticate your FlagScanner account;
  • Verify membership status and entitlement;
  • Display incidents and articles;
  • Display maps and related public-safety information;
  • Provide live scanner audio;
  • Provide scanner archives;
  • Display arrest logs;
  • Retrieve Priority Alerts and other FlagScanner content;
  • Display weather, traffic, road-condition, or related information;
  • Maintain secure authenticated sessions; and
  • Perform security and application functionality.

FlagScanner does not collect sensitive device information or request sensitive device permissions unless they are necessary for a feature offered by the application and appropriately disclosed.

The types of data and device permissions used by the mobile applications may change as features are added or modified. This Privacy Policy will be updated when necessary to accurately reflect material changes to our data practices.

Protected Content and Local Caching

To improve performance and provide authorized features, the FlagScanner mobile application may temporarily cache certain content or account-related information on the user’s device. Subscriber-only or otherwise protected information may be cached only as necessary to provide authorized application functionality. Protected cached information is cleared or made inaccessible when the user signs out, when the applicable authenticated session is revoked, or when the application determines that the account is no longer authorized to access that information.

FlagScanner does not use protected local caching to independently determine membership entitlement. Authorization for protected FlagScanner services remains subject to server-side account and membership verification.

Embedded Video Content

Certain FlagScanner articles may contain embedded video content provided through YouTube. When a user deliberately chooses to view or play embedded YouTube content within the FlagScanner mobile application, the application may establish a connection with YouTube or its associated services through an embedded web-based video player. YouTube may receive technical information associated with that connection, such as the user’s IP address, device or browser-related information, and information necessary to deliver the requested video.

FlagScanner uses YouTube’s privacy-enhanced youtube-nocookie.com embedding where supported. The embedded player runs in an isolated incognito web view without shared FlagScanner cookies and with third-party cookies disabled; JavaScript and temporary web storage are enabled only as needed for YouTube playback. Information processed directly by YouTube is subject to Google’s and YouTube’s applicable privacy practices. FlagScanner does not use the embedded video player to obtain the user’s YouTube credentials.

Live Scanner and Archive Services

When you use FlagScanner’s live scanner or archive features, the application communicates with FlagScanner servers to obtain feed status, listener information, stream configuration, archive information, and audio necessary to provide the requested service. These communications may include temporary or session-specific information about the selected feed and playback session.

Listener counts, feed status, and related playback information may be updated while the feature is in use. This information is used to operate and secure the scanner service. FlagScanner’s mobile listener-count heartbeat expires after a short period, and archive play counts are stored only in aggregate by recording; these features do not create a persistent profile of an individual user’s listening activity.

4. HOW WE USE INFORMATION

We may use information collected through the Services to:

  • Create, authenticate, secure, and administer FlagScanner accounts;
  • Provide the Services requested by users;
  • Verify paid membership status;
  • Determine access to subscriber-only content and features;
  • Process and administer memberships;
  • Maintain authenticated sessions;
  • Provide live scanner and archive access;
  • Provide incident, map, weather, traffic, arrest-log, and related functionality;
  • Respond to customer-support inquiries;
  • Communicate about accounts, memberships, security, billing, or service matters;
  • Maintain and improve our Services;
  • Diagnose technical problems;
  • Protect FlagScanner, our users, and our systems;
  • Detect, prevent, and investigate fraud, abuse, unauthorized account sharing, security incidents, and violations of our Terms of Service;
  • Resolve billing disputes and chargebacks;
  • Comply with legal, tax, accounting, regulatory, or law-enforcement obligations; and
  • Enforce our Terms of Service and other agreements.

We do not use personal information for purposes materially inconsistent with this Privacy Policy without providing appropriate notice or obtaining consent where required.

5. EMAIL AND COMMUNICATIONS

FlagScanner may use your email address or other contact information to send communications reasonably necessary to administer your account, membership, billing, security, or Services you request.

If FlagScanner offers promotional or marketing email or SMS communications, those communications will be subject to applicable consent and opt-out requirements.

Consent to receive marketing communications is not a condition of purchasing a FlagScanner membership unless expressly permitted by applicable law.

You may opt out of marketing communications using the unsubscribe or opt-out mechanism provided with those communications.

Opting out of marketing communications does not necessarily prevent FlagScanner from sending transactional or service-related communications necessary to administer your account, membership, security, or Services.

6. INFORMATION YOU SEND TO FLAGSCANNER

If you contact FlagScanner by email, contact form, or another communication method, we may retain and use the information you provide to respond to your request, provide support, improve our Services, maintain appropriate business records, protect our legal interests, or comply with applicable law.

Messages may be shared internally with FlagScanner employees, contractors, or authorized personnel who need the information to respond to or address the matter.

If you communicate with FlagScanner regarding a matter involving a government or public-safety agency, information contained in that communication may in some circumstances become subject to disclosure through legal process, law-enforcement investigation, or applicable public-record laws if it is subsequently provided to such an agency.

Please do not send sensitive personal information to FlagScanner unless it is necessary for your request.

7. HOW WE SHARE INFORMATION

FlagScanner does not disclose personal information to third parties except as necessary to operate our Services, administer memberships, process transactions, provide requested functionality, maintain security, comply with law, or as otherwise described in this Privacy Policy.

We may disclose information to the following categories of recipients:

Service Providers

We may use companies or service providers that assist us with functions such as:

  • Website and server hosting;
  • Application infrastructure;
  • Membership administration;
  • Payment processing;
  • Email or communications;
  • Security;
  • Technical support;
  • Content delivery; and
  • Other services necessary to operate FlagScanner.

These providers may process information only as necessary to provide services to us or as otherwise permitted by their agreements and applicable law.

We expect third parties receiving user data on our behalf to provide appropriate protection for that information.

Payment Providers

Payment processors may collect payment information directly from you when you purchase a membership.

Their handling of payment information is governed by their own applicable privacy policies and terms.

FlagScanner may receive transaction and membership information necessary to confirm payments, administer subscriptions, resolve disputes, process refunds where applicable, prevent fraud, and maintain business records.

Legal and Safety Disclosures

We may disclose information when we reasonably believe disclosure is necessary or appropriate to:

  • Comply with applicable law;
  • Respond to a valid subpoena, court order, warrant, or other lawful legal process;
  • Respond to lawful requests from law-enforcement or governmental authorities;
  • Protect the rights, property, security, or safety of FlagScanner, our users, or others;
  • Investigate fraud, abuse, security incidents, or unlawful activity; or
  • Establish, exercise, or defend legal claims.

Business Transfers

If Scanner Log USA LLC or FlagScanner is involved in a merger, acquisition, restructuring, sale of assets, financing, bankruptcy, or similar business transaction, information may be transferred as part of that transaction, subject to applicable law.

8. SALE OF PERSONAL INFORMATION AND TRACKING

FlagScanner does not sell personal information to data brokers.

FlagScanner does not knowingly share personal information with unaffiliated third parties for their own independent direct marketing purposes except where clearly disclosed and permitted by applicable law.

The production mobile application may use third-party technologies necessary to provide application functionality. Before application-store submission, FlagScanner reviews the privacy practices of integrated third-party software and services and makes required disclosures through this Privacy Policy and applicable application-store privacy disclosures.

If our practices materially change, we will update this Privacy Policy and make other disclosures or obtain consent where required.

9. THIRD-PARTY SERVICES AND EXTERNAL LINKS

FlagScanner uses or may rely upon third-party services to provide certain functionality, including hosting, payment processing, maps, traffic information, weather information, public-safety information, media, and other services.

FlagScanner may also provide links to websites or resources operated by third parties.

We do not control the privacy practices of independent third-party websites and services. When you leave FlagScanner or interact directly with a third party, that party’s privacy policy and terms may govern its collection and use of information.

We encourage you to review the privacy policies of third-party services you choose to use.

10. DATA SECURITY

FlagScanner uses reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, misuse, or destruction.

These measures may include, where appropriate:

  • Encrypted HTTPS communications;
  • Secure authentication mechanisms;
  • Restricted server-side authorization;
  • Secure storage mechanisms for mobile authentication credentials;
  • Session expiration and revocation;
  • Access controls;
  • Security monitoring; and
  • Other measures appropriate to the nature of the information being processed.

No internet transmission, computer system, mobile device, or storage system can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

Users are responsible for maintaining the confidentiality of their account credentials and should not share passwords or authentication credentials with others.

11. DATA RETENTION

FlagScanner retains personal information only for as long as reasonably necessary for the purposes for which it was collected or processed, including to:

  • Provide the Services;
  • Maintain account and membership records;
  • Comply with legal, accounting, and tax obligations;
  • Prevent fraud and abuse;
  • Resolve disputes and chargebacks;
  • Maintain security;
  • Enforce our agreements; and
  • Protect legitimate business and legal interests.

Retention periods may vary depending on the type of information and the purpose for which it is maintained.

When information is no longer reasonably necessary for the applicable purpose, we may delete, anonymize, or otherwise dispose of it in accordance with applicable law and our operational requirements.

12. ACCOUNT DELETION AND DATA DELETION

FlagScanner users may request permanent deletion of their FlagScanner account and associated personal information.

Account deletion is separate from membership cancellation.

Canceling a paid membership does not automatically delete your FlagScanner account. Likewise, deleting a FlagScanner account may not automatically cancel an active recurring subscription administered by a third-party payment provider or application store.

Where applicable, users should cancel active recurring subscriptions before completing account deletion.

Users may initiate or request account deletion through the account-management options provided in the FlagScanner mobile application or through FlagScanner’s designated account-deletion resource on our website.

When account deletion is completed, FlagScanner will delete the account and personal information associated with it except for information we are required or permitted to retain for legitimate purposes, including:

  • Legal or regulatory compliance;
  • Tax and accounting obligations;
  • Fraud prevention;
  • Security;
  • Dispute resolution;
  • Chargeback management; and
  • Establishment, exercise, or defense of legal claims.

Information retained for these purposes will be limited to what is reasonably necessary for the applicable purpose and retained only as long as reasonably necessary or legally required.

Account deletion is permanent, and deleted information may not be recoverable.

Apple currently requires apps supporting account creation to provide an in-app mechanism for initiating deletion of the user’s account. Google Play similarly requires account deletion to be available through the app and through an external web resource. FlagScanner provides or will provide these mechanisms as applicable to its distributed mobile applications.

FlagScanner will ordinarily complete a verified account-deletion request within seven (7) days. The maximum normal processing period is thirty (30) days. Additional time may be used only when reasonably necessary or legally required, including for identity verification, legal obligations, accounting or tax obligations, security investigation, fraud prevention, dispute resolution, chargeback management, or other legitimate retention requirements disclosed in this Privacy Policy.

Once account deletion has been completed, FlagScanner will send a confirmation to the email address associated with the account when reasonably possible. Information legitimately retained after deletion does not keep the deleted FlagScanner user account active or usable.

13. MEMBERSHIP CANCELLATION

Membership cancellation and account deletion are different actions.

Canceling a recurring membership prevents future renewal according to the applicable membership terms but does not itself request deletion of your FlagScanner account or personal information.

14. YOUR PRIVACY CHOICES

Depending on your use of FlagScanner and applicable law, you may have options to:

  • Review or update certain account information;
  • Cancel a membership;
  • Opt out of eligible marketing communications;
  • Request deletion of your account;
  • Request deletion of associated personal information; and
  • Contact FlagScanner with questions about information associated with your account.

Some rights may vary depending upon your location and applicable law.

We may take reasonable steps to verify the identity of a person making a privacy or account request to protect users against unauthorized access or deletion.

We will not discriminate against users for exercising privacy rights provided by applicable law.

15. CHILDREN’S PRIVACY

FlagScanner is a general-audience news and public-safety information service and is not directed to children under 13.

We do not knowingly collect personal information from children under 13 in violation of applicable law.

If we learn that personal information from a child under 13 has been collected in circumstances requiring parental consent and such consent was not obtained, we will take reasonable steps to delete the information.

A parent or legal guardian who believes a child has provided personal information to FlagScanner may contact us using the information provided below.

16. UNITED STATES OPERATIONS

FlagScanner is operated by Scanner Log USA LLC in the United States.

If you access the Services from outside the United States, information may be processed and stored in the United States, where privacy and data-protection laws may differ from those in your jurisdiction.

Your use of the Services is subject to applicable law.

17. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes in:

  • Our Services;
  • Mobile application functionality;
  • Data practices;
  • Third-party service providers;
  • Legal requirements; or
  • Apple App Store or Google Play requirements.

When we make material changes, we will update the “Last Updated” date at the top of this Privacy Policy and may provide additional notice where appropriate or required by law.

We encourage users to review this Privacy Policy periodically.

18. TERMS OF SERVICE

Your use of FlagScanner is also governed by our Terms of Service.

If there is a conflict between this Privacy Policy and the Terms of Service concerning the collection, use, retention, or deletion of personal information, this Privacy Policy will control with respect to those privacy matters, subject to applicable law.
